These Terms of Service ("Terms") govern your use of the CommentGem Chrome extension and the commentgem.com website (collectively, the "Service"), operated by CommentGem ("we," "our," or "us"). By using the Service, you agree to these Terms.

1. Description of Service

CommentGem is a Chrome browser extension that collects and analyzes YouTube video comments using the YouTube Data API. The Service provides features including comment filtering, search, timestamp navigation, sharing, AI-powered chat analysis, and data export. The Service is available in free and paid (Pro) tiers.

2. Eligibility

You must be at least 13 years of age to use CommentGem. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that you have your parent or guardian's consent.

3. User accounts

Some features require you to create an account. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information and to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

After your free trial period, CommentGem requires you to provide your own YouTube Data API key to continue using the comment collection features. By providing your API key, you acknowledge that:

5.1 Free tier

The free tier includes 3 complimentary video analyses using our server-side API key. After the trial, you must provide your own YouTube API key (free from Google) for unlimited comment collection. Free tier features include: comment filters, search, timestamps, and comment sharing.

5.2 Pro tier ($4.99/month)

The Pro tier includes all free features plus: AI Chat with comments (powered by Gemini, no separate API key required), sentiment analysis, CSV/data export, custom themes, panel position customization, and priority support. Pro subscriptions are billed monthly through Stripe. You may cancel at any time — access continues until the end of the billing period.

6. Payment and refunds

Pro subscriptions are billed monthly at $4.99 USD via Stripe. Prices may change with 30 days' notice. Payments are non-refundable except as required by applicable law. If you experience a billing issue, contact us at support@commentgem.com and we will work to resolve it fairly.

CommentGem and its original content, features, and functionality are owned by CommentGem and are protected by applicable intellectual property laws. YouTube comments displayed through the Service are owned by their respective authors and YouTube. The CommentGem name, logo, and branding are our trademarks.

9. Shared comments

When you use the share feature to create comment cards or shareable links, you are sharing publicly available YouTube comments. You are responsible for ensuring your use of shared content complies with applicable laws and YouTube's Terms of Service. Shared links may be accessible to anyone with the link.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We are not responsible for the accuracy or content of YouTube comments displayed through the Service. YouTube may change their API at any time, which may affect the Service's functionality.

11. Limitation of liability

To the maximum extent permitted by law, CommentGem shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities, arising from your use of the Service. Our total liability for any claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may stop using the Service at any time by uninstalling the extension and canceling any active subscription. Upon termination, your right to use the Service ceases immediately.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you disagree with the changes, you should stop using the Service.

14. Governing law

These Terms are governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms will be resolved through good-faith negotiation first, and if necessary, through binding arbitration.
